The Tenants Deposit Scheme and inventories.

 

The scheme, which became law in April 2007,  is to resolve deadlocked tenancy disputes over the apportionment and settlement of deposits following the end of a tenancy. Under the new law, any holder of a tenant’s deposit must hold that deposit in one of two ways:

Insured and Bonded Scheme – landlords or agents who join this kind of scheme can still hold the tenants’ deposits until the end of the tenancy.
(Association of Rental and Letting Agency - ARLA, RICS and NAEA members already run such a scheme, and it is widely supported, although it is not compulsory for their members).


Custodial Scheme – members of this kind of scheme will be required to hand all tenants’ deposits to the scheme provider for safe keeping until the end of the tenancy.

 

If there is a disagreement between landlord and tenant at the end of a tenancy, all details of the dispute, along with the deposit money that cannot be settled, will be sent to the Independent Case Examiner for the Scheme. This will then be subject to independent third party adjudication, who will then apportion the deposit money.

 

They will make their decisions based on standard and detailed tenancy documentation. Inventories and check out reports are vital to this process. Without them there will simply be no case to answer. The tenant will undoubtedly receive his full deposit back and the landlord could be seriously out of pocket in terms of compensation costs. So detailed inventories are vitally important. Independently supplied inventories will undoubtedly carry the greatest weight.
